By using this software application and the services, you agree to be bound by the terms of this license (the “Terms”).

Your relationship is with the Sika legal entity that granted you this software license (“Licensor”). The term “We” refers to the Licensor.

These Terms shall be governed by and construed in accordance with the substantive laws of Switzerland, excluding its conflict of law provisions. The United Nations Convention on Con-tracts for the International Sale of Goods (CISG) shall not apply to these Terms. Any dispute, controversy, or claim arising out of or in connection with these Terms, including the existence, validity, interpretation, performance, breach or termination thereof, shall be resolved exclusively by the ordinary courts of Geneva, Switzerland. The Parties hereby irrevocably submit to the exclusive jurisdiction of the Geneva courts and waive any objection to proceedings in such courts on the grounds of venue or inconvenient forum.

This software application and services are protected by copyright laws and international copyright treaties. The software application and services are licensed, not sold.

Subject to your compliance with the Terms and applicable law, we hereby grant you a non-exclusive, limited, revocable right for you to install, access and use the services and software that we make available to you, and that you license from us.

We remain the sole owner of all right, title, and interest in the services and software.

For additional terms and information that are specific to this software application and services, please refer to the Product Datasheet for this software application or services that are linked from this software application of service.

We may make changes to the Terms from time to time. We will notify you of any change to the Terms through this software application or service. Unless otherwise noted, the amend-ed Terms will be effective immediately, and your continued use of our services and software confirm your acceptance of the changes. If you do not agree to the amended Terms, you must stop using our services and software.

We may, from time to time, modify and replace the features and functionalities, as well as the user interface, of the software and services. If such changes lead to a material degradation of the functionalities, you may terminate the license or service with immediate effect and we will pro-rata reimburse any fees that you may have paid in advance for the remaining service period.

We may suspend your use of the software and services, if we, at our sole but reasonable discretion, have deemed your use of the software or services to be fraudulent, abusive or outside the scope of the license granted herein.

We may revoke this license or service at any time by serving you notice or by terminating your use of the services and software.

We do not owe you any compensation for termination of license or services, except for pro-rate reimbursement of any fees that you may have paid in advance for the remaining service or license period.

For information about how we collect, use, share, or otherwise process information about you and your use of our services and software, please see our privacy policy that is linked from this software application or service.

Data Analyses means aggregated data related to customer and its software users use of the software, as well as data and information retained or compiled by Sika (or on Sikas' behalf) by reviewing, using, processing, analyzing, transforming or storing data and information (which may include segments of customer data) for providing and/or improving the software or Sika's other product or service offerings. Furthermore, the software may incorporate analytics tools in order to optimize customer’s use and experience of the software. Notwithstanding anything to the contrary, Sika may also retain and compile Data Analyses by re-viewing, using, processing, analyzing, transforming, and/or storing data and information (which may include segments of customer data) to provide and/or improve the software and Sika's other product and service offerings. For clarity, Data Analyses shall not be considered confidential information of the customer.   

THIS SOFTWARE APPLICATION, SERVICE AND THE RESULTS DERIVED FROM ITS UTILIZATION ARE INTENDED ONLY FOR USE BY PROFESSIONAL USERS WITH EXPERT KNOWLEDGE IN THE AREA OF THE INTENDED APPLICATION. USERS MUST INDEPENDENTLY VERIFY THE RESULTS BEFORE ANY USE AND TAKE INTO ACCOUNT THE SITE AND APPLICATION CONDITIONS, REQUIREMENTS OF THE APPLICATION, PRODUCT DATA SHEET AND PRODUCT LITERATURE, TECHNICAL STATE OF THE ART AS WELL AS LOCAL APPLICABLE STANDARDS AND REGULATIONS.

With respect to the software application, service and results derived from its use, SIKA MAKES NO WARRANTIES OF ACCURACY, RELIABILITY, COMPLETENESS, MERCHANTABILITY OR FITNESS FOR ANY PURPOSE. THE SOFTWARE APPLICATION AND SERVICE ARE PROVIDED ON AN “AS-IS” BASIS AND SIKA EXPRESSLY DISCLAIMS ANY WARRANTIES WITH RESPECT TO THE SOFTWARE APPLICATION, SERVICE AND RESULTS DERIVED FROM ITS USE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIKA'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERM OR THE SOFTWARE APPLICATION AND SERVICES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL BE LIMITED TO, AT SIKA'S SOLE OPTION, EITHER: (A) RESUPPLYING THE SOFTWARE APPLICATION AND SERVICES; OR (B) REFUNDING THE FEES PAID BY CUSTOM-ER FOR THE SOFTWARE APPLICATION AND SERVICES GIVING RISE TO THE CLAIM. THIS LIMITATION OF LIABILITY AND SOLE REMEDY PROVISION SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

We recommend that you back up any data that is generated or stored in the software or services elsewhere regularly, even if the software or services provide storage and this functionality is enabled by the applicable software or services. Upon termination of the license or service we will delete any data that you may have stored in the software or service.

Sika shall not be liable for any consequential, punitive, incidental, exemplary, or special damages (including but not limited to loss of data, loss of business opportunity or loss of profit) arising out of the evaluation or use of the software application, service and results derived from its use.

Sika’s total liability in any matter arising out of or related to the Terms is limited to the aggregate amount that you paid for access to the software and services during the three-month period preceding the event giving rise to the liability.

The information, and, in particular, the recommendations relating to the application and end-use of Sika products, are given in good faith based on Sika's current knowledge and experience of the products when properly stored, handled and applied under normal conditions in accordance with Sika’s recommendations. In practice, the differences in materials, substrates and actual site conditions are such that no warranty in respect of merchantability or of fitness for a particular purpose, nor any liability arising out of any legal relationship what-soever, can be inferred either from the results derived from the use of the software application, or from any written recommendations, or from any other advice offered. The user of the product must test the product’s suitability for the intended application and purpose. Sika reserves the right to change the properties of its products. The proprietary rights of third parties must be observed. All orders are accepted subject to our current terms of sale and delivery. Users must always refer to the most recent issue of the local Product Data Sheet for the product concerned, copies of which will be supplied on request.

Sika’s total liability in any matter arising out of or related to the Terms is limited to the aggregate amount that you paid for access to the software and services during the three-month period preceding the event giving rise to the liability.

The information, and, in particular, the recommendations relating to the application and end-use of Sika products, are given in good faith based on Sika's current knowledge and experience of the products when properly stored, handled and applied under normal conditions in accordance with Sika’s recommendations. In practice, the differences in materials, substrates and actual site conditions are such that no warranty in respect of merchantability or of fitness for a particular purpose, nor any liability arising out of any legal relationship whatsoever, can be inferred either from the results derived from the use of the software application, or from any written recommendations, or from any other advice offered. The user of the product must test the product’s suitability for the intended application and purpose. Sika reserves the right to change the properties of its products. This software application and services are protected by copyright laws and international copyright treaties. The software application and services are licensed, not sold.

Subject to your compliance with the Terms and applicable law, we hereby grant you a non-exclusive, limited, revocable right for you to install, access and use the services and software that we make available to you, and that you license from us.

We remain the sole owner of all right, title, and interest in the services and software.

For additional terms and information that are specific to this software application and services, please refer to the Product Datasheet for this software application or services that are linked from this software application of service.

We may make changes to the Terms from time to time. We will notify you of any change to the Terms through this software application or service. Unless otherwise noted, the amended Terms will be effective immediately, and your continued use of our services and software confirm your acceptance of the changes. If you do not agree to the amended Terms, you must stop using our services and software.

We may, from time to time, modify and replace the features and functionalities, as well as the user interface, of the software and services. If such changes lead to a material degradation of the functionalities, you may terminate the license or service with immediate effect and we will pro-rata reimburse any fees that you may have paid in advance for the remaining service period.

We may suspend your use of the software and services, if we, at our sole but reasonable discretion, have deemed your use of the software or services to be fraudulent, abusive or outside the scope of the license granted herein.

We may revoke this license or service at any time by serving you notice or by terminating your use of the services and software.

We do not owe you any compensation for termination of license or services, except for pro-rate reimbursement of any fees that you may have paid in advance for the remaining service or license period.

For information about how we collect, use, share, or otherwise process information about you and your use of our services and software, please see our privacy policy that is linked from this software application or service.

Data Analyses means aggregated data related to customer and its software users use of the software, as well as data and information retained or compiled by Sika (or on Sikas' behalf) by reviewing, using, processing, analyzing, transforming or storing data and information (which may include segments of customer data) for providing and/or improving the software or Sika's other product or service offerings. Furthermore, the software may incorporate analytics tools in order to optimize customer’s use and experience of the software. Notwithstanding anything to the contrary, Sika may also retain and compile Data Analyses by reviewing, using, processing, analyzing, transforming, and/or storing data and information (which may include segments of customer data) to provide and/or improve the software and Sika's other product and service offerings. For clarity, Data Analyses shall not be considered confidential information of the customer.

THIS SOFTWARE APPLICATION, SERVICE AND THE RESULTS DERIVED FROM ITS UTILIZATION ARE INTENDED ONLY FOR USE BY PROFESSIONAL USERS WITH EXPERT KNOWLEDGE IN THE AREA OF THE INTENDED APPLICATION. Sika는 본 소프트웨어 애플리케이션, 서비스 및 이로부터 도출된 결과의 정확성, 신뢰성, 완전성, 상업성, 특정 목적에의 적합성에 대해 어떠한 보증도 하지 않으며, 이와 관련된 모든 보증을 명시적으로 부인합니다. 본 소프트웨어 애플리케이션과 서비스는 "있는 그대로(AS-IS)" 제공됩니다.

본 소프트웨어 또는 서비스에 저장 기능이 제공되고 해당 기능이 활성화되어 있는 경우에도, 소프트웨어나 서비스 내에서 생성되거나 저장된 데이터를 정기적으로 외부에 백업할 것을 권장합니다. 라이선스 또는 서비스가 종료되면 귀하가 소프트웨어나 서비스에 저장한 데이터는 삭제됩니다.

Sika는 소프트웨어 애플리케이션, 서비스 및 그 사용과 사용으로부터 도출된 결과의 평가로 인해 발생하는 결과적 손해, 징벌적 손해, 부수적 손해, 예시적 손해, 특별 손해(예를 들어 데이터 손실, 사업 기회 상실, 이익 손실 등을 포함하며 이에 한정되지 않음)에 대해 어떠한 책임도 지지 않습니다.

본 약관과 관련하여 발생하는 모든 청구 및 분쟁에 대해서, Sika의 책임은 해당 책임이 발생하기 직전 3개월 동안 귀하가 소프트웨어 및 서비스 이용을 위해 실제로 지불한 총 금액을 한도로 제한됩니다.

Sika 제품의 적용 및 최종 사용에 대한 정보와 권장사항은, Sika의 현재 지식과 경험에 기반하여 선의로 제공되는 것으로, Sika의 제품이 정상적인 조건에서 Sika의 권장사항에 따라 적절히 보관, 취급 및 적용된다는 것을 전제로 합니다.

실제 제품 사용시 재료, 기질 및 현장 조건 등의 차이로 인해, 소프트웨어 애플리케이션의 사용 결과, 서면 권장 사항 또는 기타 조언으로부터 상품성, 특정 목적에의 적합성 및 어떠한 법적 관계에 따른 책임도 명시적 또는 묵시적으로 보장되지 않습니다.

제품 사용자는 의도하는 용도 및 목적에 대한 제품의 적합성을 직접 시험해야 합니다.

Sika는 제품의 특성을 변경할 수 있는 권리를 가지고 있습니다.

제3자의 지식재산권은 반드시 준수되어야 합니다.

모든 주문은 당사의 최신 판매 및 납품 약관에 따라 수락됩니다.

사용자는 해당 제품에 대한 가장 최신의 지역 제품 데이터시트를 반드시 참조해야 하며, 요청 시 사본을 제공받을 수 있습니다.

Door deze softwaretoepassing en diensten te gebruiken, gaat u akkoord met de voorwaarden van deze licentie (de "Voorwaarden") en bent u daaraan gebonden.

U hebt een relatie met de juridische entiteit van Sika die u deze softwarelicentie heeft verleend ('Licentiegever'). De term "Wij" verwijst naar de Licentiegever.

Het toepasselijke recht is het recht van het rechtsgebied van de contracterende (licentieverlenende) Sika-entiteit: in dit geval het Nederlandse recht.

Deze softwaretoepassing en -diensten worden beschermd door auteursrechtwetten en internationale auteursrechtverdragen. De softwaretoepassing en -diensten worden in licentie gegeven, niet verkocht.

Op voorwaarde dat u zich houdt aan de Voorwaarden en de toepasselijke wetgeving, verlenen wij u hierbij een niet-exclusief, beperkt, herroepbaar recht om de software en diensten die wij u ter beschikking stellen en waarvoor u een licentie van ons in licentie geeft, te installeren, te openen en te gebruiken.

Wij blijven de enige eigenaar van alle rechten, aanspraken en belangen in de software en diensten.

Voor aanvullende voorwaarden en informatie die specifiek zijn voor deze softwaretoepassing en diensten, verwijzen wij u naar het productgegevensblad voor deze softwaretoepassing of diensten die zijn gekoppeld vanuit deze softwaretoepassing of diensten.

Wij kunnen van tijd tot tijd wijzigingen aanbrengen in de Voorwaarden. Wij zullen u via deze softwaretoepassing of -diensten op de hoogte stellen van elke wijziging in de Voorwaarden. Tenzij anders vermeld, zijn de gewijzigde Voorwaarden onmiddellijk van kracht en bevestigt uw voortgezet gebruik van onze software en diensten dat u de wijzigingen accepteert. Als u niet akkoord gaat met de gewijzigde Voorwaarden, moet u stoppen met het gebruik van onze software en diensten.

Wij kunnen van tijd tot tijd de kenmerken en functionaliteiten, evenals de gebruikersinterface, van de software en diensten wijzigen en vervangen. Als dergelijke wijzigingen leiden tot een wezenlijke verslechtering van de functionaliteiten, kunt u de licentie of dienst met onmiddellijke ingang beëindigen en zullen wij alle kosten die u mogelijk vooraf hebt betaald voor de resterende serviceperiode naar rato vergoeden.

Wij kunnen uw gebruik van de software en diensten opschorten als wij, naar eigen goeddunken, uw gebruik van de software of diensten hebben beschouwd als frauduleus, beledigend of buiten het bereik van de hierin verleende licentie.

Wij kunnen deze licentie of dienst op elk gewenst moment intrekken door u hiervan op de hoogte te stellen of door uw gebruik van de software en diensten te beëindigen.

Wij zijn u geen enkele vergoeding verschuldigd voor beëindiging van de licentie of diensten, met uitzondering van een evenredige vergoeding van eventuele kosten die u mogelijk vooraf hebt betaald voor de resterende dienst- of licentieperiode.

Voor informatie over hoe wij informatie over u en uw gebruik van onze software en diensten verzamelen, gebruiken, delen of anderszins verwerken, verwijzen wij u naar ons privacybeleid dat is gekoppeld aan deze softwaretoepassing of -dienst.

Gegevensanalyse betekent dat samengevoegde gegevens met betrekking tot het gebruik van de software door de klant en zijn softwaregebruikers, evenals gegevens en informatie die door Sika (of namens Sika) worden bewaard of verzameld door het beoordelen, gebruiken, verwerken, analyseren, transformeren of opslaan van gegevens en informatie (die segmenten van klantgegevens kunnen bevatten) voor het leveren en/of verbeteren van de software of het andere product- of dienstenaanbod van Sika. Bovendien kan de software analysetools bevatten om het gebruik en de ervaring van de software door de klant te optimaliseren. Ongeacht andersluidende bepalingen, kan Sika ook gegevensanalyses bewaren en samenstellen door gegevens en informatie (die segmenten van klantgegevens kunnen bevatten) te bekijken, te gebruiken, te verwerken, te analyseren, te transformeren en/of op te slaan om de software en het andere product- en dienstenaanbod van Sika te leveren en/of te verbeteren. Voor alle duidelijkheid: gegevensanalyses worden niet beschouwd als vertrouwelijke informatie van de klant.

DEZE SOFTWARETOEPASSING, DIENST EN DE RESULTATEN DIE DAARUIT VOORTVLOEIEN, ZIJN UITSLUITEND BEDOELD VOOR GEBRUIK DOOR PROFESSIONELE GEBRUIKERS MET DESKUNDIGE KENNIS OP HET GEBIED VAN DE BEOOGDE TOEPASSING. GEBRUIKERS MOETEN DE RESULTATEN ONAFHANKELIJK VERIFIËREN VOORDAT ZE DEZE GEBRUIKEN EN REKENING HOUDEN MET DE LOCATIE- EN TOEPASSINGSOMSTANDIGHEDEN, DE VEREISTEN VAN DE TOEPASSING, HET PRODUCTGEGEVENSBLAD EN DE PRODUCTLITERATUUR, DE TECHNISCHE STAND VAN DE TECHNIEK EN DE LOKAAL GELDENDE NORMEN EN VOORSCHRIFTEN.

MET BETREKKING TOT DE SOFTWARETOEPASSING, DE DIENSTEN EN DE RESULTATEN DIE VOORTVLOEIEN UIT HET GEBRUIK ERVAN, GEEFT SIKA GEEN GARANTIES MET BETREKKING TOT NAUWKEURIGHEID, BETROUWBAARHEID, VOLLEDIGHEID, VERKOOPBAARHEID OF GESCHIKTHEID VOOR WELK DOEL DAN OOK. DE SOFTWARETOEPASSING EN -DIENST WORDEN GELEVERD OP EEN "AS-IS"-BASIS EN SIKA WIJST UITDRUKKELIJK ALLE GARANTIES AF MET BETREKKING TOT DE SOFTWARETOEPASSING, DE DIENST EN DE RESULTATEN DIE VOORTVLOEIEN UIT HET GEBRUIK ERVAN.

Wij raden u aan om regelmatig elders een back-up te maken van alle gegevens die in de software of diensten worden gegenereerd of opgeslagen, zelfs als de software of diensten opslag bieden en deze functionaliteit wordt ingeschakeld door de betreffende software of diensten. Bij beëindiging van de licentie of dienst zullen wij alle gegevens verwijderen die u mogelijk in de software of diensten hebt opgeslagen.

Sika is niet aansprakelijk voor enige schade, waaronder maar niet beperkt tot gevolgschade, punitieve, incidentele, exemplarische of speciale schade (inclusief maar niet beperkt tot verlies van gegevens, verlies van zakelijke kansen of winstderving) die voortvloeit uit de evaluatie of het gebruik van de softwaretoepassing, diensten en resultaten die zijn afgeleid van het gebruik ervan.

De totale aansprakelijkheid van Sika in alle gevallen die voortvloeien uit of verband houden met de Voorwaarden is beperkt tot het totale bedrag dat u hebt betaald voor toegang tot de software en diensten gedurende de periode van drie maanden voorafgaand aan de gebeurtenis die aanleiding gaf tot de aansprakelijkheid.

De informatie, en in het bijzonder de aanbevelingen met betrekking tot de toepassing en het eindgebruik van Sika-producten, worden te goeder trouw gegeven op basis van Sika's huidige kennis van en ervaring met de producten wanneer ze op de juiste manier worden opgeslagen, gehanteerd en toegepast onder normale omstandigheden in overeenstemming met de aanbevelingen van Sika. In de praktijk zijn de verschillen in materialen, substraten en feitelijke omstandigheden op de locatie van dien aard dat geen enkele garantie met betrekking tot de verkoopbaarheid of geschiktheid voor een bepaald doel, noch enige aansprakelijkheid die voortvloeit uit welke rechtsbetrekking dan ook, kan worden afgeleid uit de resultaten die voortvloeien uit het gebruik van de softwaretoepassing, noch uit schriftelijke aanbevelingen, of van enig ander aangeboden advies. De gebruiker van het product moet de geschiktheid van het product voor de beoogde toepassing en het beoogde doel testen. Sika behoudt zich het recht voor om de eigenschappen van haar producten te wijzigen. De eigendomsrechten van derden moeten in acht worden genomen. Alle bestellingen worden geaccepteerd onder toepassing van  onze huidige verkoop- en leveringsvoorwaarden. Gebruikers moeten altijd de meest recente uitgave van het lokale productgegevensblad voor het betreffende product raadplegen, waarvan kopieën op verzoek worden verstrekt.

Sika® en de productnamen van Sika-producten waarnaar in deze softwaretoepassing wordt verwezen, zijn gedeponeerde handelsmerken van Sika AG. Alle andere producten en merknamen kunnen handelsmerken of gedeponeerde handelsmerken zijn van hun respectievelijke eigenaren.

Subject to your compliance with the Terms and applicable law, we hereby grant you a non-exclusive, limited, revocable right for you to install, access and use the services and software that we make available to you, and that you license from us.

We remain the sole owner of all right, title, and interest in the services and software.

We may make changes to the Terms from time to time. We will notify you of any change to the Terms through this software application or service. Data Analyses means aggregated data related to customer and its software users use of the software, as well as data and information retained or compiled by Sika (or on Sikas' behalf) by reviewing, using, processing, analyzing, transforming or storing data and information (which may include segments of customer data) for providing and/or improving the software or Sika's other product or service offerings. Furthermore, the software may incorporate analytics tools in order to optimize customer’s use and experience of the software. Notwithstanding anything to the contrary, Sika may also retain and compile Data Analyses by re-viewing, using, processing, analyzing, transforming, and/or storing data and information (which may include segments of customer data) to provide and/or improve the software and Sika's other product and service offerings. For clarity, Data Analyses shall not be considered confidential information of the customer.   

THIS SOFTWARE APPLICATION, SERVICE AND THE RESULTS DERIVED FROM ITS UTILIZATION ARE INTENDED ONLY FOR USE BY PROFESSIONAL USERS WITH EXPERT KNOWLEDGE IN THE AREA OF THE INTENDED APPLICATION. USERS MUST INDEPENDENTLY VERIFY THE RESULTS BEFORE ANY USE AND TAKE INTO ACCOUNT THE SITE AND APPLICATION CONDITIONS, REQUIREMENTS OF THE APPLICATION, PRODUCT DATA SHEET AND PRODUCT LITERATURE, TECHNICAL STATE OF THE ART AS WELL AS LOCAL APPLICABLE STANDARDS AND REGULATIONS.

Sika shall not be liable for any consequential, punitive, incidental, exemplary, or special damages (including but not limited to loss of data, loss of business opportunity or loss of profit) arising out of the evaluation or use of the software application, service and results derived from its use.

Sika’s total liability in any matter arising out of or related to the Terms is limited to the aggregate amount that you paid for access to the software and services during the three-month period preceding the event giving rise to the liability.

The information, and, in particular, the recommendations relating to the application and end-use of Sika products, are given in good faith based on Sika's current knowledge and experience of the products when properly stored, handled and applied under normal conditions in accordance with Sika’s recommendations. In practice, the differences in materials, substrates and actual site conditions are such that no warranty in respect of merchantability or of fitness for a particular purpose, nor any liability arising out of any legal relationship what-soever, can be inferred either from the results derived from the use of the software application, or from any written recommendations, or from any other advice offered. THIS SOFTWARE APPLICATION, SERVICE AND THE RESULTS DERIVED FROM ITS UTILIZATION ARE INTENDED ONLY FOR USE BY PROFESSIONAL USERS WITH EXPERT KNOWLEDGE IN THE AREA OF THE INTENDED APPLICATION. USERS MUST INDEPENDENTLY VERIFY THE RESULTS BEFORE ANY USE AND TAKE INTO ACCOUNT THE SITE AND APPLICATION CONDITIONS, REQUIREMENTS OF THE APPLICATION, PRODUCT DATA SHEET AND PRODUCT LITERATURE, TECHNICAL STATE OF THE ART AS WELL AS LOCAL APPLICABLE STANDARDS AND REGULATIONS.

With respect to the software application, service and results derived from its use, SIKA MAKES NO WARRANTIES OF ACCURACY, RELIABILITY, COMPLETENESS, MERCHANTABILITY OR FITNESS FOR ANY PURPOSE. THE SOFTWARE APPLICATION AND SERVICE ARE PROVIDED ON AN “AS-IS” BASIS AND SIKA EXPRESSLY DISCLAIMS ANY WARRANTIES WITH RESPECT TO THE SOFTWARE APPLICATION, SERVICE AND RESULTS DERIVED FROM ITS USE.

We recommend that you back up any data that is generated or stored in the software or services elsewhere regularly, even if the software or services provide storage and this functionality is enabled by the applicable software or services. Upon termination of the license or service we will delete any data that you may have stored in the software or service.

Sika shall not be liable for any loss of use, data, profit or revenue, or for any indirect consequential, punitive, incidental, exemplary, or special damages (including but not limited to loss of data, loss of business opportunity or loss of profit) arising out of the evaluation or use of the software application, service and results derived from its use.

Sika’s total liability in any matter arising out of or related to the Terms is limited to the aggregate amount that you paid for access to the software and services during the three-month period preceding the event giving rise to the liability.

The information, and, in particular, the recommendations relating to the application and end-use of Sika products, are given in good faith based on Sika's current knowledge and experience of the products when properly stored, handled and applied under normal conditions in accordance with Sika’s recommendations. In practice, the differences in materials, substrates and actual site conditions are such that no warranty in respect of merchantability or of fitness for a particular purpose, nor any liability arising out of any legal relationship whatsoever, can be inferred either from the results derived from the use of the software application, or from any written recommendations, or from any other advice offered. The user of the product must test the product’s suitability for the intended application and purpose. Sika reserves the right to change the properties of its products. The proprietary rights of third parties must be observed. All orders are accepted subject to our current terms of sale and delivery. Users must always refer to the most recent issue of the local Product Data Sheet for the product concerned, copies of which will be supplied on request.
